Please note that we, Medavas, reserve the right to make changes to these Terms and Conditions at any time. If we make any modifications, they will become effective immediately upon posting. By using this website, you are deemed to agree with all the terms and conditions of Medavas, which provides counselling and therapy services.

It is important to note that the website is only available to individuals who are 18 years of age or older. If you are a minor, you are not permitted to register as a member of the website, and access to the website is only allowed with parental guidance or under the supervision of a legal guardian.

We reserve the right to terminate your membership or account at any time if it comes to our attention or if we discover that you are under the age of eighteen (18) years. Furthermore, we will not be held liable for any harm that may result from the use of the website without parental consent.

1. Definitions

1.1 “Company” refers to Medavas Health Pvt. Ltd., a company registered under the laws of India with its registered office located in Haryana, India.

1.2 “Website” refers to www.medavas.com, its subdomains, and any other associated web pages.

1.3 “User” refers to any individual who accesses or uses the Website and its services.

1.4 “Therapists, Psychologists, Doctors, and Counsellors” refers to licensed and qualified professionals who offer consultation and therapy services through the Medavas platform.

1.5 “Services” refers to the services provided by the Company through the Website, including but not limited to connecting patients with Therapists, Psychologists, Doctors, and Counsellors, facilitating online consultations, and helping professionals increase their visibility.

2. Website Ownership

The website and its content are the sole property of Medavas. We exclusively own the rights to the content. You are prohibited from removing, altering, copyrighting, trademarking, reproducing, modifying, adapting, preparing, displaying, publishing, selling, or broadcasting any of the content belonging to Medavas. The Medavas name and logo are the exclusive property of Medavas and may not be copied or used in whole or in part without prior consent.

3. Eligibility

3.1 By accessing or using the Website, you affirm that you are at least 18 years old and have the legal capacity to enter into this Agreement.

3.2 If you are accessing or using the Website on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to this Agreement.

4. Use of the Website

4.1 The Website and its Services are intended for personal and non-commercial use. You may use the Website to connect with Therapists, Psychologists, Doctors, and Counsellors, schedule consultations, and access relevant information.

4.2 You understand and acknowledge that the Company is not a medical or healthcare provider, and the Website is not intended to replace professional medical advice or treatment. The Company does not guarantee the accuracy or effectiveness of any information provided on the Website.

4.3 The Company reserves the right to modify, suspend, or discontinue any part of the Website or its Services at any time without prior notice.

4.4 Users are only permitted to use the website for lawful purposes. As stated above, you are not allowed to post or transmit any material that infringes upon the rights of others, is threatening, abusive, defamatory, libelous, invades privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable.

You agree not to:

  • Copy, distribute, or disclose any part of the website in any medium.
  • Engage in spamming, sending unsolicited letters or emails, or any other forms of unsolicited communication.
  • Interfere with the system integrity or security, or decipher any transmissions to or from the servers running the website.

5.3 The Company reserves the right to suspend or terminate your account if it determines, in its sole discretion, that you have violated any provision of this Agreement.

6. Online and Face-to-face Consultations

6.1 The Website facilitates online and face-to-face consultations between Users and Therapists, Psychologists, Doctors, and Counsellors. The Company does not endorse or guarantee the availability, quality, or effectiveness of any professional services provided through the Website.

6.2 You understand and acknowledge that the Company is not responsible for the outcome of any consultations or the actions or omissions of the professionals. It is your responsibility to evaluate the qualifications and suitability of the professionals before engaging in any consultations.

6.3 You agree to provide accurate and complete information during the consultation process and to disclose any relevant medical or psychological history.

6.4 Payment for consultations shall be made through the designated payment gateway on the Website. The Company is not responsible for any payment processing issues or disputes.

7. Payments, Refunds, & Cancellations

At Medavas, we charge for online and face-to-face counselling sessions conducted via face-to-face, video call, chat or phone. When you avail any of these services, it is important to understand and agree to the following terms and conditions:

All charges paid by customers for any of the services at Medavas are non-refundable. If a customer is dissatisfied with any counselling service received, they can send an email to info@medavas.com, and the matter will be thoroughly reviewed by our team. The decision of Medavas regarding such matters will be final and binding.

The date of the online and face-to-face counselling session cannot be changed unless specifically informed by the Medavas team. If a customer fails to use the service during the specified period, no refunds shall be provided. However, requests for changes to chat or phone sessions are subject to availability on a first-come, first-served basis.

During the use of any purchased services, Medavas will make a maximum of three attempts to reach you. If the customer fails to respond within four days of the last communication, the service will be considered consumed, and no refunds will be provided.

In case of technical difficulties during a session, Medavas will thoroughly investigate the issue. If the case is deemed genuine, we will reschedule the appointment.

Medavas shall not be responsible for any fraudulent transactions, declines, or lack of authorization that may arise due to the use of Internet Banking/Debit/Credit Cards (“Virtual Payment Mode”).

Medavas reserves the right to change the charges for any of the services at any time without prior notice to the customer. Any such changes shall be binding and effective on the user.

8. Disclaimer

Any advice provided by Medavas experts via the website is for informational purposes only. This information should not be considered a substitute for examinations of your condition by a doctor or a professional mental health expert.

You also agree that any advice or counselling provided by an expert, counsellor, doctor, or therapist through Medavas is solely your responsibility. We disclaim any and all liability for the services provided through Medavas.

Please note that this service is not intended for emergencies. If you believe you need immediate attention, please contact your nearest healthcare provider or hospital.

Additionally, Medavas is NOT A SUICIDE HELPLINE. If you believe you are in danger of causing harm to yourself or others, please notify appropriate agencies such as the police or emergency medical personnel.

If you use any of our services on the website, you do so solely at your own risk. Medavas will not be liable in any manner.

9. Intellectual Property

9.1 The content and materials on the Website, including but not limited to text, graphics, logos, images, and software, are owned or licensed by the Company and are protected by copyright, trademark, and other intellectual property laws.

9.2 You may not modify, reproduce, distribute, transmit, display, or create derivative works from any content on the Website without the prior written consent of the Company.

10. Limitation of Liability

10.1 The Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use the Website or its Services.

10.2 The Company does not guarantee the availability, accuracy, or reliability of the professionals or the information provided on the Website. The Company shall not be liable for any errors or omissions in such information.

11. Indemnification

11.1 You agree to indemnify and hold the Company, its affiliates, and their respective directors, officers, employees, and agents, harmless from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Website, your interactions with professionals, or any violation of this Agreement.

12. Privacy & Security

12.1 The Company collects and processes personal information in accordance with its Privacy Policy. By using the Website, you consent to the Company’s collection and use of personal information as described in the Privacy Policy.

When using the website, you acknowledge and consent to the collection, use, and disclosure of your personally identifiable information and aggregate data as outlined in our Privacy Policy.

Medavas cannot guarantee that any third-party website will be unable to defeat our security systems or use your personal information for improper purposes.

13. Warranty

Medavas does not guarantee, warrant, endorse, or assume responsibility for any product advertised or offered by a third party through our website unless hyperlinked in the content.

We shall not be liable for monitoring any transaction between you and third-party providers of products and services. The use of the website is at your own risk. Medavas will not be liable for any damage to your computer or phone caused by any content downloaded from our website, including loss of data, viruses, worms, or technical damage.

17. Professional Responsibilities

17.1 The professionals, including Therapists, Psychologists, Doctors, and Counsellors, who provide services through the Website are solely responsible for maintaining their professional licenses, qualifications, and ethical standards.

17.2 The Company does not endorse, guarantee, or verify the credentials, qualifications, or professional abilities of the professionals listed on the Website. It is the User’s responsibility to evaluate and select a professional based on their own judgment, requirements, and preferences.

17.3 The Company reserves the right to remove or suspend the profile of any professional if it receives credible complaints or determines, in its sole discretion, that the professional has violated ethical standards, engaged in fraudulent activities, or provided substandard services.

18. User Responsibilities

18.1 Users agree to provide accurate, truthful, and complete information when using the Website and its services, including during the registration process and consultations.

18.2 Users understand and agree that the information shared during consultations is confidential and must not be disclosed or shared with any third parties without the explicit consent of the professional.

18.3 Users are solely responsible for their interactions and communications with professionals through the Website. The Company shall not be held liable for any consequences arising from such interactions.

19. Modification of Terms

19.1 The Company reserves the right to modify or update this Agreement at any time without prior notice. The updated Agreement will be effective upon posting on the Website. It is your responsibility to review this Agreement periodically for any changes.

19.2 By continuing to access or use the Website after the modifications have been made, you agree to be bound by the updated Agreement.

20. Termination

20.1 The Company reserves the right to suspend or terminate your access to the Website or its Services at any time and for any reason, without prior notice or liability.
