Terms and Conditions

These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “Client”, or “You”) and Medavas Health Private Limited (“Medavas”, “Company”, “we”, “our”, or “us”).

This Agreement governs your access to and use of the Medavas Website (www.medavas.com), the Medavas Mobile Application (available on Google Play Store as com.medavas.app and Apple App Store), and all digital healthcare, psychological tele-consultation, and wellness services (collectively, the “Platform” or “Services”).

1. Scope of Platform Services

Medavas operates as an online technology platform that enables users to connect with certified psychologists, psychiatrists, therapists, counsellors, and wellness experts (“Practitioners” or “Experts”) for tele-consultations via video, audio, and secure messaging, as well as providing self-care wellness tools, mood tracking, and clinical screeners.

• Independent Practitioners: Practitioners on Medavas are independent licensed professionals responsible for the clinical advice, counselling, and therapies they provide. Medavas does not interfere with the professional medical judgment of licensed practitioners.
• Digital Wellness Tools: Guided breathing exercises, sleep soundscapes, mood trackers, and clinical assessment screeners (such as PHQ-9, GAD-7) provided on the app are educational self-help tools and do not constitute a formal psychiatric diagnosis.

2. User Eligibility & Account Responsibilities

• You must be at least 18 years of age to register an independent account. Minors may access services only with verifiable parental or legal guardian consent and supervision.
• You agree to provide accurate, current, and complete information during registration and keep your account details updated.
• You are solely responsible for maintaining the confidentiality of your login credentials, passwords, and biometric access. You agree to notify Medavas immediately of any unauthorized access to your account.

3. Appointments, Bookings & Wallet

• Consultation Bookings: Sessions are scheduled based on the practitioner's verified calendar availability. A booking is confirmed once payment or wallet deduction is successfully authorized.
• In-App Wallet: The Medavas digital wallet allows clients to maintain funds for instant session bookings and receive instant refunds. Wallet balances are non-transferable to third-party users and may be utilized for any service on the Platform.
• Rescheduling & Cancellations: Clients may reschedule or cancel appointments in accordance with the Platform's cancellation policies prior to the slot start time.
• Refunds: Refunds for cancelled or unfulfilled sessions are governed by our official Refund Policy and credited to the original payment source or client wallet.

4. Mobile App Store Distribution Terms

If you download or access the Medavas Mobile Application from Google Play (Google LLC) or the Apple App Store (Apple Inc.):

• You acknowledge that this Agreement is concluded between you and Medavas Health Private Limited only, and not with Google LLC or Apple Inc.
• Google LLC and Apple Inc. have no obligation to furnish maintenance, support, or clinical guarantees with respect to the Medavas Application.
• You agree to comply with all applicable third-party terms of agreement when using the Application (such as your wireless data service provider terms).

5. Intellectual Property Rights

All software, mobile code, visual interfaces, graphics, design, compilation, audio soundscapes, wellness routines, and trademark logos associated with Medavas are the exclusive intellectual property of Medavas Health Private Limited. You are granted a limited, personal, non-exclusive, non-transferable license to use the Platform strictly for personal, non-commercial healthcare purposes.

6. Privacy & Data Protection

Your privacy and data protection are governed by our comprehensive Privacy Policy, which is incorporated by reference into these Terms. By using the Platform, you consent to the collection, transmission, and processing of data as described therein.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Medavas Health Private Limited, its directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to or use of the Platform, including but not limited to technical interruptions or third-party telecommunication failures.

8. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. The courts of New Delhi, India shall have exclusive jurisdiction over any disputes arising from this Agreement.
